TECHNICAL PROVISIONS ON CERTIFICATE OF ORIGIN OF CERTAIN EXPORTED GOODS
THE DIRECTOR GENERAL OF FOREIGN TRADE,
Considering:
- a. that in order to implement the provision in Article 3 of Regulation of the Minister of Finance No. 17/M-DAG/ PER/9/2005 on the Issuance of Certificate of Origin to Indonesia's Exported Goods, it is necessary to regulate certificate of origin of certain exported goods;
- b. that in relation thereto, it is necessary to issue a regulation of the Director General of Foreign Trade;
In view of:
- 1. Presidential Decree No. 34/M/2005 on the Appointment of First-Echelon Officials the Minister of Trade;
- 2. Regulation off the Minister of Trade No. 01/M-DAG/PER/3/2004 on the Organization and Working Arrangement of the Ministry of Trade;
- 3. Regulation of the Minister of Trade No. 17/M-DAG/PER/9/2005 on the Issuance of Certificate of Origin to Indonesia's exported goods;
DECIDES :
To stipulate :
THE REGULATION OF THE DIRECTOR GENERAL OF FOREIGN TRADE ON TECHNICAL PROVISIONS ON CERTIFICATE OF ORIGIN OF CERTAIN EXPORTED GOODS
Article 1
(1) Certain goods whose export must be accompanied by Certificate of Origin (SKA) shall be textile and clothing destined to the United States and European Union as well-as shrimp products as contained in Attachment I to this regulation.
(2) The certain goods as meant in paragraph (1) shall be accompanied SKA Form B or international agreement based SKA.
(3) Verification of sources of raw materials and production processes can be applied to the export of certain goods.
Article 2
(1) Requirements for the issuance of SKA of certain exported goods shall be as follows:
- a. Copy of Export Declaration (PEB) already securing loading-approval from officers of Customs and Excise Service Offices at loading ports or printout of PEB made by Electronic Data Interchange (EDI), accompanied by original copy of Export Approval (PE);
- b. Original Copy of Master Bill of Landing (Non-Negotiable B/L) or copy of Air Way Bill (AWB) or copy of Air Way Cargo Receipt in the case of the export being realized through mainland;
- c. Supporting data about sources of raw materials, in the form of:
- c.1 Data about corporate production
- c.2 Data about local purchase:
- - purchasing invoice
- - local invoice
- c.3 Data about import purchase:
- - Bill or Lading
- - Invoice
- - SKA of country of origin of goods.
- d. The letter of statement of application for SKA as meant in Attachment II to this regulation.
Article 3
(1) Only institutions issuing special SKA can issue SKA to certain exported goods.
(2) The institutions issuing special SKA as meant in paragraph (1) shall be as contained in Attachment II to this regulation.
Article 4
(1) The institutions issuing special SKA to certain goods shall be restricted in certain regions, adjusted to centers of industries.
(2) Reduction or addition to institutions issuing special SKA to certain exported goods, signing officials or alternate officials shall be stipulated by the Director General of Foreign Trade.
Article 5
The institutions issuing special SKA shall convey report on the realization of the export on the basis of the export of certain exported goods as contained in Attachment IV to this regulation , very month to the Director of Export and Import Facilities, Directorate General of Foreign Trade, Ministry of Trade.
Article 6
The regulation shall come into force as from the date of stipulation.
